2. Free Trial

7-Day Free Trial: New users are eligible for a 7-day free trial period. During this trial:

• You have full access to all features of the Service
• No credit card is required to start your trial
• You may cancel at any time during the trial period without charge
• After 7 days, your account will automatically convert to a paid subscription unless canceled
• Each user is limited to one free trial per lifetime

3. Billing and Payment

Following your free trial, subscription fees are billed monthly in advance. You agree that:

• All fees are non-refundable except as required by law
• You authorize us to charge your payment method on a recurring basis
• You are responsible for all applicable taxes
• We may change our fees with 30 days' notice
• Failure to pay may result in suspension or termination of your account

4. Acceptable Use

5. TCPA Compliance

Important: You are solely responsible for compliance with the Telephone Consumer Protection Act (TCPA) and all applicable telemarketing laws. You represent and warrant that:

• You have obtained all necessary consents before making calls
• You maintain and honor Do Not Call (DNC) lists
• You comply with all calling time restrictions
• You maintain records as required by law
• You will indemnify us for any violations of TCPA or related laws

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI WHOLESALE DIALER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

7. Termination

Either party may terminate these Terms at any time:

• You may cancel your account at any time through your account settings
• We may suspend or terminate your account for violation of these Terms
• We may discontinue the Service with 30 days' notice
• Upon termination, your right to use the Service will immediately cease
• All provisions which by their nature should survive termination shall survive

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Ohio.
